Whether an Enforcement Notice under Article 30 of the Regulatory Reform (Fire Safety) Order 2005 has been served in respect of Peake Court, 2 Cavalier Close, Wallington, SM6 8DL. 

If an Enforcement Notice has been served: (a) the date on which it was served; (b) the identity of the Responsible Person on whom it was served; (c) the steps required by the notice; (d) the compliance deadline specified in the notice. 

If an Enforcement Notice has NOT yet been served: whether the LFB intends to serve one, and if so, the expected timeline. 

Whether a Notification of Fire Safety Deficiencies (NOD) was issued following the inspection on 17 December 2025, and if so, a copy of that NOD with any necessary personal data redactions. 

A copy of any correspondence between the LFB and the Responsible Person for Peake Court (P Win Properties / Winston Group) regarding fire safety compliance at the premises since 17 December 2025.

Please see my response to your requests in turn below, based on the information provided to me by LFB’s Prevention and Protection department (Fire Safety Regulatory): 

Whether an Enforcement Notice under Article 30 of the Regulatory Reform (Fire Safety) Order 2005 has been served in respect of Peake Court, 2 Cavalier Close, Wallington, SM6 8DL.

As of the date of your FOI request (16 March 2026), no Enforcement Notice has been served on Peake Court, 2 Cavalier Close, Wallington, SM6. 

If an Enforcement Notice has been served: (a) the date on which it was served; (b) the identity of the Responsible Person on whom it was served; (c) the steps required by the notice; (d) the compliance deadline specified in the notice.

If an Enforcement Notice has NOT yet been served: whether the LFB intends to serve one, and if so, the expected timeline.

A Notification of Fire Safety Deficiencies (NOD) letter was sent to Peake Court Management Company Limited on 16 March 2026.  A NOD letter is a non-statutory notice, where the concerns are unlikely to place people at serious risk.  The NOD letter includes a schedule listing the breaches in the Order we have identified as well as a possible solution to remedy the deficiency. There is no offence of failing to comply with a Notification of Fire Safety Deficiencies. However, if the Responsible Person (RP) fails to address the deficiencies identified a subsequent statutory notice (such as an Enforcement Notice) may be issued. The failure to comply can also be used as evidence in any subsequent prosecution. 

Whether a Notification of Fire Safety Deficiencies (NOD) was issued following the inspection on 17 December 2025, and if so, a copy of that NOD with any necessary personal data redactions.

A Notification of Fire Safety Deficiencies (NOD) letter was sent to Peake Court Management Company Limited on 16 March 2026.  I have included a copy of the letter in the "Documents" section below. Personal data has been removed from the NOD letter under section 40 of the FOIA – Personal Information. 

A copy of any correspondence between the LFB and the Responsible Person for Peake Court (P Win Properties / Winston Group) regarding fire safety compliance at the premises since 17 December 2025.

There is no correspondence held on the Fire Safety Regulatory department file between the LFB and “P Win Properties” and/or the “Winston Group”.

The Notification of Fire Safety Deficiencies (NOD) letter was sent to Peake Court Management Company Limited on 16 March 2026.  This letter was also emailed to “Beckenham and Bromley Property Management Limited” on 17 March 2026.
